Dora and the difference between traffic violations and infringements
Dora Drift:
In your last post you mention violations of the SVG. There are also simple and gross traffic rule violations. What is the difference between traffic violations and infringements?
Answer:
Hello Dora
Traffic rule violations and infringements are concepts under road traffic law and differ as follows:
The violation of traffic regulations is a criminal offense. According to Art. 90 SVG, a distinction is made between simple (penalty: fine) and gross traffic offences (penalty: imprisonment or fine).
On the other hand, violations of road traffic regulations constitute a qualification under administrative law. According to Art. 16a ff. of the SVG, a distinction is made between minor, moderate and serious offenses, with each gradation having different legal consequences in terms of administrative measures (warnings, withdrawal of ID, etc.).
