As a lawyer specializing in juvenile criminal law, Fabian Füllemann was interviewed by Blick about the Berikon AG case.
In Berikon AG, a 15-year-old schoolgirl was so seriously injured with a knife that she died on the spot. The circumstances of the case are currently unclear and many questions remain unanswered. But what will the alleged perpetrator have to face now?
As part of the reporting on the Berikon AG case, lawyer Fabian Füllemann was asked as a lawyer for juvenile criminal law how authorities and courts deal with such extreme cases.
Lawyer for juvenile criminal law: Juvenile criminal law differs fundamentally from adult criminal law
While adult criminal law focuses primarily on the offense, juvenile criminal law is aimed in particular at education.
In particular, juvenile criminal law has its own catalog of sanctions. For example:
- Protective measures such as supervision, personal care, outpatient treatment and accommodation
- Reference
- personal performance
- Buses (only from the age of 15)
- Deprivation of liberty (only from the age of 15)
Protective measures more likely than prison sentence
The alleged perpetrator is only 14 years old. Accordingly, a custodial sentence is unlikely to be handed down. Depending on the facts of the case, outpatient or inpatient treatment in a suitable institution – at most until the age of 22 – is more likely.
