Bite incidents & liability of the dog owner

What should I do if my dog has bitten someone?

A dog bite can have serious legal consequences for the dog owner. In addition to possible claims for damages or criminal charges, there is also the threat of administrative measures such as muzzling, compulsory use of a lead or even confiscation of the dog.

📌 Who is liable for a dog bite?

Animal owner liability according to OR 56: Dog owners are generally liable for damage caused by their dogs – regardless of fault. An exception only applies if the owner can prove that they took all necessary measures to prevent the incident.
Possible criminal consequences: If a dog injures someone, this can be considered negligent bodily harm or a violation of the Animal Welfare Act.
Administrative sanctions: Depending on the canton, authorities can order measures such as a leash requirement, muzzle requirement or even confiscation of the dog.

📌 How can I defend myself against conditions or confiscation?

If you are threatened with official requirements or sanctions following an incident, we will check whether these are proportionate and lawful. Especially if you are threatened with euthanization or confiscation, you should take legal action immediately.

🔹 Seek advice at an early stage! Early legal action can prevent disproportionate measures being taken against you and your dog.

Dog law for rental apartments & neighborhood disputes

Can my landlord prohibit me from keeping dogs?

The keeping of dogs in rented apartments repeatedly leads to legal disputes between tenants, landlords and neighbors. Many dog owners ask themselves: Can my landlord forbid me to keep a dog?

📌 Can my landlord impose a general ban on dogs?

Check the tenancy agreement: If the tenancy agreement contains an explicit ban on dogs, the tenant must generally comply with it – unless the ban is disproportionate.
No provision in the tenancy agreement? Without a clear clause, the landlord can only prohibit dog ownership if the dog is demonstrably causing considerable disturbance (e.g. noise, odor nuisance).
Breed lists & cantonal regulations: In some cantons, additional regulations apply to certain dog breeds – this can also have an impact on tenancies.

📌 What to do if neighbors complain?

Barking dogs: While occasional barking is not a problem, persistent noise can lead to legal consequences. Landlords or neighbors can demand a warning or even termination of the tenancy agreement.
Take action against unfounded complaints: If you are wrongly accused of noise nuisance or other violations, we will support you in defending yourself against unlawful claims or termination.

📌 Secure your right to keep dogs!

If your landlord or your neighbors make unlawful demands or you want to enforce dog ownership, we will check the legal situation and support you in asserting your interests.

📞 Seek advice at an early stage – we are here for you!

Keeping dogs on a chain: the deceptive gap between federal law and cantonal practice

The tethering of dogs is a legal minefield. While federal law theoretically permits tethering under strict conditions, some cantonal veterinary authorities are cracking down and effectively banning permanent tethering. Anonymous report to the veterinary office: Can I find out the identity of the person making the report?

When the veterinary office contacts pet owners, there is often a great deal of uncertainty.
