What is a warning withdrawal?

A warning withdrawal is a temporary withdrawal of a driver’s license. It is issued in the event of a serious or repeated violation of the Road Traffic Act (SVG).

Minor traffic violations are generally punished with a fine and do not lead to administrative measures. In the case of more serious or repeated offenses, however, the authorities will order the driver’s license to be revoked.

The law provides for a so-called cascade system. The duration and consequences of the measure increase with each subsequent offense. Previous entries in the administrative register have a direct impact on the duration of the withdrawal. In certain constellations, this can lead to considerably longer withdrawal periods.

A withdrawal of a warning can have far-reaching consequences, especially for people with a professional driving dependency. We examine the order, assess the classification of the offense and represent you in objection or appeal proceedings.

When is there a risk of an indefinite driving disqualification?

The suspension is a driving disqualification for an indefinite period. It is ordered if there are doubts about the driver’s fitness to drive.

In contrast to the withdrawal of a warning, the focus is not on the sanctioning of a specific offense, but on the question of whether the person concerned is fit to drive a motor vehicle in terms of health or character.

If there are any doubts, the authorities usually order a traffic medical examination. This serves to clarify fitness to drive and may relate to health restrictions, substance use or mental stability, among other things. The driver’s license is only issued again once fitness to drive has been proven.

Traffic offenses - which offenses are punishable?

The Road Traffic Act (SVG) contains numerous criminal offenses. Depending on the severity of the offense, fines, prison sentences and administrative measures such as a driving disqualification may be imposed.

The most common traffic offenses include speeding, distance violations, driving while unfit to drive (such as under the influence of alcohol, drugs or medication), failure to control the vehicle and driving a vehicle that is not roadworthy.

The legal consequences depend largely on the specific classification of the offense (minor, moderate or serious) and any previous charges. In addition to criminal proceedings, administrative proceedings are also regularly to be expected.
