Official defense

The term “public defender” does not exist in the Code of Criminal Procedure. Instead, the term official defense is used.

An official defense counsel must be appointed if more than 10 days of pre-trial detention, including provisional arrest, have been imposed, if a prison sentence of more than 1 year is imminent, if the accused person is unable to sufficiently safeguard their procedural rights themselves and for other procedural reasons(Art. 130 StPO).

Furthermore, an official defense counsel is appointed at the request of the accused if the criminal charge is not a trivial matter, the criminal case presents difficulties in factual or legal terms and the accused person is not up to the task and does not have the necessary resources (see Art. 132 StPO).
