Experts for social security law – Central in Winterthur
Are you looking for a lawyer for social security law? Our law firm is centrally located in Winterthur and specializes, among other things, in the representation of IV and UVG legal cases(SUVA and other accident insurers). Our experts in social insurance law handle numerous, often medically complex legal cases in this area before the cantonal authorities and cantonal insurance courts. Due to the focus of their work, our lawyers have already successfully conducted numerous IV and proceedings against accident insurers, primarily SUVA, and can demonstrate considerable expertise in social insurance law. Are you looking for a lawyer for your IV or UVG case? For case inquiries from new clients, your social security lawyer will first conduct an initial consultation with you. This costs a flat rate of CHF 330 and, together with the case inspection, takes about an hour. We look forward to receiving your appointment request.
The services of your lawyer for social security law include the following areas, among others:
Representation vis-à-vis cantonal IV authorities, SUVA and other accident insurers ・Representation vis-à-vis health insurance companies and daily sickness allowance insurers ・ Preparation of objections, appeals and complaints ・ Representation before cantonal social insurance courts ・ Examination and correct preparation of the medical facts with regard to the applicable law
IV is the most important pillar of disability provision in Switzerland (1st pillar). Like the AHV, it is a compulsory insurance scheme. Its aim is to secure the livelihood of insured persons with integration measures or cash benefits if they become disabled.
The IV primarily grants integration measures. When registering for reintegration measures or for a pension, the entitlement to a pension is only examined if the earning capacity cannot be restored, maintained or improved through reintegration measures.
Your lawyer for social insurance law provides support with questions relating to integration measures and the examination and enforcement of pension claims.
As the largest provider of compulsory accident insurance in Switzerland, Suva insures around half of all employees in Switzerland against the consequences of occupational and non-occupational accidents and occupational illnesses.
As a person insured with Suva, you are entitled to the following insurance benefits following an accident or occupational illness:
Your social insurance lawyer will be happy to assist you in examining and enforcing claims against SUVA and other accident insurers.
If employees are absent from work for an extended period due to illness or pregnancy, they are still entitled to their salary for a certain period of time. This obligation to continue to pay wages shall be borne by the employer. A written agreement, standard employment contract or collective employment contract may provide for a different arrangement if it is at least equivalent for the employee. This includes taking out daily sickness benefits insurance. This is equivalent if it pays daily benefits of 80% of the salary for a maximum of 720 days within 900 days with half of the premium split.
In our experience, daily sickness benefits insurers often try to refuse further benefits after approx. 1 year of providing benefits, almost as standard. A careful examination of the facts of the case and your entitlement to further daily allowance benefits by a social security lawyer is therefore often worthwhile.
Anyone who is employed or lives in Switzerland is required to have health insurance and must take out health insurance in accordance with the Federal Health Insurance Act (KVG). In certain situations, you can be exempted from compulsory insurance. We are happy to assist with questions regarding compulsory insurance, for example for cross-border commuters.
If your health insurance company denies you benefits, our lawyers are the right people to contact. Your social security lawyer will examine your case and enforce your claim for sickness benefit, rehabilitation or other treatment.
In social insurance law, the (medical) facts are defined in accordance with Art. 43 para. 1 ATSG ex officio.
Nevertheless, in practice, incorrect medical findings are repeatedly made, particularly due to the complexity of the interface between medicine and law. Your social security lawyer will ensure that your case is assessed correctly and completely on the basis of conclusive expert opinions and medical reports. Where the authorities are granted statutory discretion, we check this discretion for errors and appropriateness.
For case inquiries from new clients, your social security lawyer will first conduct an initial consultation. This costs a flat rate of CHF 330 and, together with the case inspection, takes about an hour. The initial meeting can take place either on site in our office, by video call or by telephone.
At the initial meeting, we will discuss your concerns, will draw up the facts of the case with you and check your documents. You will then receive an initial legal assessment from us. We also discuss the next steps and provide you with recommendations for action. If it is necessary to engage a lawyer, we agree on the terms of the mandate, the underlying strategy, the goal to be achieved and the next steps.
We support you every step of the way
